Terms of Service
Effective date: October 15, 2026
These Terms of Service ("Terms") are an agreement between you and PlanSage, LLC ("PlanSage," "we," "us," or "our"). They govern your use of the PlanSage website, applications and services (together, the "Service"). By creating an account, starting a trial, subscribing, or otherwise using the Service, you agree to these Terms. If you are accepting on behalf of an agency or other business, you confirm that you have authority to bind it, and "you" includes that business.
1. What PlanSage is, and what it is not
PlanSage is a plan comparison and decision-support tool for licensed insurance agents and agencies. It organizes publicly available Medicare Advantage and Part D plan information, ranks plans according to the priorities you select, and helps you prepare cost worksheets and client-ready summaries.
PlanSage is a tool for you, the licensed professional. It does not enroll anyone in a plan, does not make enrollment decisions, does not provide insurance, legal, tax or medical advice, and does not replace your professional judgment. PlanSage is not directed at Medicare beneficiaries and must not be used to communicate with them except through you.
2. Eligibility and accounts
- You must be at least 18 years old and a licensed insurance agent, or an agency that employs or contracts with licensed agents, to use the Service.
- The information you give us, including your name, email, licensing details and the states you select, must be accurate and kept up to date. We may verify licensing information and may suspend or close an account that fails verification.
- You are responsible for keeping your login credentials secure and for all activity under your account. Each login is for one person. Tell us promptly at support@plansageapp.com if you suspect unauthorized use.
3. Plans, trials and billing
Current plans, prices and what each plan includes are shown on our website and at checkout. The price and terms shown at checkout when you subscribe are the ones that apply to you. Payments are processed by our payment processor, Stripe. Subscriptions renew automatically each billing period until cancelled. Prices do not include taxes; where applicable, taxes are added.
3.1 Free trial (Solo and Solo Unlimited)
- Solo and Solo Unlimited start with a 14-day free trial. A payment card is required to start it.
- If you do not cancel before the trial ends, your card is charged automatically on day 15 for the plan and market coverage you selected, and every billing period after that.
- During the trial, Detailed Analysis is limited to 12 uses. The limit is removed once your subscription is paid.
- A trial is available once per account. If you cancel and later return, payment is due when you resubscribe.
- Agency, Founding Agent and Founding Agency subscriptions have no trial and are charged when you subscribe.
3.2 Market coverage
Each plan includes a set number of states. Access to additional states is priced in bands as shown on our website. You may only use the Service for the states included in your subscription.
3.3 Founding Agent offer
- The Founding Agent offer is limited to the first 100 subscribers. It is $49 per month and includes up to 10 selected states and early access to new features before general release.
- Your $49 rate is locked for as long as your Founding Agent subscription remains active and in good standing, even if our standard prices rise. It is a recurring subscription with a protected rate, not a one-time or lifetime license.
- Unlimited Detailed Analysis is subject to reasonable professional use. We may address automated use, credential sharing or usage that does not resemble one agent's real workflow.
- "Updates included" refers to updates to the features of the plan you subscribed to, not to every future product, add-on or separately priced module. States beyond your 10 and optional add-ons are billed at then-current prices.
- Founding Agent status is non-transferable and limited to one account per business. If your subscription ends, you have 30 days to contact us at support@plansageapp.com to restore your Founding Agent status and locked rate. After 30 days, both are permanently lost.
3.4 Agency and Founding Agency
- Agency subscriptions are priced per seat with a minimum of 5 seats. The agency's account owner, and administrators the owner designates, manage the agency's agents and seats.
- The Founding Agency offer is limited to the first 10 agencies. It is $50 per seat per month, with every state PlanSage covers included at no extra charge, locked for as long as the Founding Agency subscription remains active and in good standing. The same non-transferability and reasonable-use rules described for Founding Agent apply. Founding Agency status and the locked rate end when the subscription ends.
- If an Agency or Founding Agency subscription falls below 5 seats, the agency has 30 days to return to 5 or more. If it does not, the subscription is cancelled at the end of that period.
3.5 Price changes
We may change our standard prices. We will give existing subscribers at least 30 days' notice by email or in the Service before a price change applies to them. Changes apply from your next billing period after the notice period, never to a period you have already paid for. Locked Founding rates are not affected while they remain in effect.
3.6 Failed payments
If a payment fails, we and Stripe may retry it. We may suspend access to the Service until the balance is paid, and we may cancel a subscription that remains unpaid.
3.7 Complimentary access
We may grant complimentary or discounted access at our discretion. Complimentary access can be changed or ended at any time.
4. Cancellation and refunds
- The account owner can cancel at any time from the account. For a paid subscription, cancellation takes effect at the end of the current billing period, and you keep access until then.
- Fees already paid are non-refundable, including for partial billing periods and unused features, except where the law requires otherwise.
- Cancelling during a free trial ends the trial immediately and avoids the first charge.
5. Your license and acceptable use
While your subscription is active and you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own licensed insurance business. You may not:
- resell, sublicense, rent or provide the Service to anyone outside your subscription;
- share a login between people, or let more people use the Service than your subscription allows;
- scrape, copy or bulk-extract plan data, rankings, Detailed Analysis text or other content from the Service, except for normal use with your own clients;
- reverse-engineer, interfere with or attempt to bypass any security, usage limit or access control of the Service;
- use the Service to build a competing product, or for any unlawful purpose.
6. Plan data, rankings and Detailed Analysis
Plan information in the Service comes from publicly available Centers for Medicare & Medicaid Services (CMS) files and is updated periodically, not in real time. Some details may be unavailable for some plans and are shown as not available rather than estimated.
Rankings are produced by rules applied to the priorities you choose. Detailed Analysis is automatically generated text that explains a ranking. Neither is a recommendation by PlanSage.
Plan data, rankings and Detailed Analysis may be incomplete, out of date or contain errors. Before you advise a client or help with any enrollment decision, you must confirm the important details against the carrier's current official materials, such as the Summary of Benefits and Evidence of Coverage. PlanSage is a research and organization tool, not a system of record for plan benefits.
7. Your compliance responsibilities
You are solely responsible for your compliance with all laws, regulations and rules that apply to your business, including CMS Medicare marketing and communications requirements, any Third-Party Marketing Organization disclaimer requirements that apply to you, state insurance laws, and the requirements of any agency, FMO or carrier you work with. This includes how you use anything you produce with the Service, such as cost worksheets, comparisons and PDFs. Any disclaimer text or formatting the Service provides is offered for convenience only. It does not shift your responsibility to us and is not legal or compliance advice.
8. Agency accounts
If you join PlanSage under an agency's account, the agency controls your seat. The agency's owner and designated administrators can add, freeze, deactivate and reactivate agents, and can see agency-level usage information, including which agents ran comparisons, when, and for which state, county and priorities. They cannot see any client personal information, because PlanSage does not collect it.
9. Suspension and termination
We may suspend, freeze or close your access, with notice where practicable, if you breach these Terms, fail to pay, fail licensing verification, use the Service in a way that could harm PlanSage, other users or third parties, or if required by law. You may stop using the Service at any time. The sections of these Terms that by their nature should survive (including sections 4, 6, 7 and 10 through 15) survive termination.
10. Intellectual property and feedback
PlanSage and its licensors own the Service, including its software, design, ranking methods and content, except for the underlying public CMS data. These Terms do not transfer any ownership to you. If you send us suggestions or feedback, we may use them without obligation to you.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANSAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANSAGE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, COMMISSIONS, BUSINESS OR DATA, EVEN IF ADVISED OF THEIR POSSIBILITY. PLANSAGE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID PLANSAGE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS INCLUDES CLAIMS ARISING FROM A CLIENT'S ENROLLMENT DECISION, AN INACCURACY IN PLAN DATA, OR AN INTERRUPTION OF THE SERVICE, INCLUDING DURING AN ENROLLMENT PERIOD.
13. Indemnification
You will defend, indemnify and hold harmless PlanSage and its members, officers and service providers from any third-party claim, loss or expense (including reasonable attorneys' fees) arising from your use of the Service, your advice to or dealings with clients, your breach of these Terms, or your violation of any law or regulation.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Georgia, and you and PlanSage consent to their jurisdiction.
15. General
These Terms and our Privacy Policy are the entire agreement between you and PlanSage about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
16. Changes to these Terms
We may update these Terms. If a change is material, we will notify you by email or in the Service at least 30 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms. If you do not agree, you may cancel before then.
17. Privacy
Our Privacy Policy explains what information we collect and how we use it.
